Conditions

1. These conditions are part of the rental agreement between tenant and landlord, Dutch law is applicable.

2. Reservation and payment; you can reserve via the website or e-mail to the landlord, after receipt from the landlord of confirmation of availability a down payment of 30% of the total sum is applicable, this amount should be received in the landlords bank account within 8 days, this confirms your reservation in to a booking, unless meanwhile another firm booking has been received, in that case you down payment is returned immediately. The balance payment needs to be received by the landlord 42 days before your booked arrival date, you are welcome to settle the total in once, however the landlord does not give interest, only after receipt of the full payment the booking is firm. The published rent is based on euro currency, fluctuations are at risk of the tenant. For last minute reservations, less than 42 days before arrival, the total sum needs to be received by the landlord direct, in any case before or on arrival. You will receive an e-mail confirmation (voucher) after receipt of full payment within 2 weeks, on this e-mail is mentioned what you are entitled for, the route description, contact details of the care taker in Cannes, verify these details and make sure you are in contact with the caretaker before arrival to inform the estimated arrival time. The amount of guests that are mentioned on the voucher is a condition, without permission this cannot increase, the care taker has the right the refuse more persons or ask additional rent / costs.

3. Prices and facilities ; The published prices are per week per villa, applicable for the season. In general a minimum stay is 7 days. The standard arrival and departure day is Saturday (high season). Other days are possible on request. Included in the rent are the usual cost of energy, except described different. The cleaning cost are € 220,–, bed linen, linen and towels are € 200, -. Deposit is € 500, which will be charged on the last invoice. Not included in the rent is eventual extra service, such as extra cleaning, wood for the chimney, etc. The description on the internet site is based on the actual situation supplied by the landlord, as they were when published, therefore they do not make part of the agreement. Especially in low and mid-season there could be some building activity near the villa, limited opening hours of shops, restaurants, swimming pool, tennis courts, ski lifts, etc., a limited offer of facilities might occur. This might also be applicable for public energy and information about climate.

4. Changes of prices and/or facilities; The description of the accommodation and the price calculation are made securely. Changes of prices and/or facility after a rental contract has been agreed, are not likely, but we cannot fully exclude these from happening. If due to unforeseen circumstances there are essential changes, tenant & landlord have the right within 5 days after this is known, to cancel the agreement, without costs, payments already effected will be refunded.

5. Arrival and departure as described in article 2, confirmation of full payment (voucher) within 2 weeks of receipt of full payment. On this e-mail is written all that has been agreed, with the full address details of the accommodation, the contact details of the caretaker and a route description. The route description will bring you to the location of the accommodation, the caretaker will meet you there. Arrival not before 16.00 hours and not after 19;00 hours, unless other arrangements have been agreed, If you estimate a late arrival, after 19;00 hours, you have to inform the caretaker ( contact details are on the confirmation mail). If for whatever reason, ( f.i. traffic, strike ) are not able to arrive at the agreed time, you will have to inform the care taker yourself, by telephone. Upon departure from the villa and the manager’s agreement, you will receive the deposit back to your account within one week. Upon departure day you have to deliver the accommodation before 10;00 a.m.

6. In case of cancelation by the tenant of the accommodation till 43 days before arrival date, the down payment (30%) will be the penalty, cancelation from 42 days before arrival date till 29 days before arrival date will cost 60%, cancelation from 28 days till 2 days before arrival date will cost 90% and cancelation from 1 day before arrival will cost 100% of the costs. The day that the cancelation notice, written or by e-mail is received by the landlord will be the cancelation date. We advise you to apply for a cancelation insurance, upon making the booking, this will cover the cancelation costs in case of illness, accidents, dead, etc. The possibilities and costs for this insurance you have to ask your broker, the landlord does not offer this insurance.

7. The landlord has the right to change or cancel the agreed rental contract if there are essential circumstances, they should be of a kind that within reason the landlord cannot be held to the agreement or conditions.

8. The tenants are obliged to follow directions or comments from the landlord or her care taker to come to a positive execution of the rental agreement and will be liable for damage caused by their actions, at the discretion of the landlord or her care taker, based on the behaviour of a correct tenant. The tenant that misbehave or does not follow the instructions of the landlord or her care taker can, by which a normal acceptable execution of the rental is not possible, can by the landlord or her care taker, be excluded and evicted from the premises, if within reason from the landlord cannot be expected that he will continue the agreement, all costs arising from this situation are for the account of the tenant.

9. Complaints/Imperfections can unfortunately occur, even though we have given detailed information. If in your accommodation there seems to be something not as expected, first you ask the care taker to solve your problem. If the situation / your complaint cannot be solved to you satisfaction, you have to inform within 3 days after arrival the landlord. Within one month after your departure from the accommodation, you will have to send your complaint in writing to the landlord with motivation. If without permission from the landlord you decide to leave the accommodation, and moves to another accommodation, you will lose your right for compensation. The landlord will not be liable for personal damage, health issues, theft or loss of possessions and valuables.
